Trigg County Sheriff Aaron Acree will not be charged in connection with a shooting last year following an altercation at a Rockcastle Road residence.
The Trigg County grand jury returned a no true bill against Acree Wednesday. Because the case was directly submitted to the grand jury, Acree was never charged with a crime. The no true bill means the grand jury didn’t find enough evidence to return an indictment.
Acree responded to a 9-1-1 call on October 28 and encountered 44-year-old Shawn Biby, who police said was attempting to cut a hole in the floor of his mobile home with a chainsaw. Kentucky State Police investigated the shooting and said an altercation followed. The sheriff fired at Biby, striking him in the torso and killing him. State police have not released any details about the shooting, haven’t said what prompted Acree to fire his weapon, or whether Biby came at Acree with a weapon.
Zac Greenwell, commonwealth’s attorney in the 5th District that includes Crittenden County, was appointed as the special prosecutor in the case by the Kentucky Attorney General’s office.
He presented the case to the grand jury in Trigg County with Judge C.A. Woodall announcing the findings during the Wednesday session of Trigg County Circuit Court.
